These terms and conditions apply to the use of this website at www.shopatchild.co.uk. By accessing this website and/or placing an order, you agree to be bound by these terms and conditions.

Using this website indicates that you accept these terms regardless of whether or not you choose to register with us or order from us. If you do not accept these terms, please do not use this website. This business operates Monday to Friday 10am - 4pm and not at weekends.

1. INTRODUCTION

1.1. You will be able to access most areas of this Website without registering your details with us. Certain areas of this Website are only open to you if you register.

1.2. We may revise these terms and conditions at any time by updating this posting. You should check this Website from time to time to review the then current terms and conditions, because they are binding on you. Certain provisions of these terms and conditions may be superseded by expressly designated legal notices or terms located on particular pages of this Website. If you do not wish to accept any new terms and conditions after we have given notice, you should not continue to use this Website.

2. ORDERING FROM US

2.1 You are deemed to place an order with us by ordering via our online checkout process, by telephone or following email order and payment by sterling cheque, verified paypal only or bank transfer. The site is automatically set up to accept orders and payment by certain credit or debit cards and paypal. As part of our checkout process, you will be given the opportunity to check your order and to correct any errors. You can add a note in the notes section to specify any additional requirements/if you want to know the postage costs if you are outside the UK etcetera. We will send you an order acknowledgement, detailing the products you have ordered. Goods are subject to availability. In the event that the goods are out of stock or we are unable to supply the goods, we will inform you of this and we will explain your options as soon as possible. You may require us to deliver the goods that are available; to arrange a back order for remaining goods; to be offered alternatives, or to cancel the order in its entirety. Designer Clothing items have a limited production and as such, once sold out, cannot usually be re-ordered (some brands do produce extra stock and we will do our best to obtain your item). You will not be charged if goods are unavailable and you will not be charged until we know we are able to dispatch the goods. Payments are made in Pounds Sterling GBP. Any exchange rates or currency conversions that may be shown on the website are intended for guidance only and you can easily conduct an internet search to obtain the most up to date conversion rates (search ‘currency convertor'). At the time of payment, conversions are made at our credit card processing bank’s prevailing rate, or Paypal's at the time the payment is taken from your card or bank account.

2.2 Our acceptance of an order takes place when we despatch the order. When we are ready to dispatch, the order will be charged and when we despatch your order, the purchase contract will be made, unless we have notified you that we do not accept your order or you have cancelled your order.

2.3 We may refuse to accept an order:

  1. where goods are not available;
  2. where we cannot obtain authorisation for your payment;
  3. if there has been a pricing or product description error; or
  4. if you do not meet any eligibility criteria set out in our terms and conditions; or
  5. if we have reason to believe the transaction is fraudulent.

3. PRICING

3.1 UK VAT (chargeable to UK and European Countries) will be added to items to which UK Vat applies, at the current rates. We express the price inclusive of VAT, if VAT applies, however we shall show VAT separately on your invoice and include it in the total price. Purchasers with billing addresses outside the VAT territories of the EC will not pay VAT.

3.2 Where we charge separately for shipping (to include packing, carriage, insurance if selected and other relevant charges), our shipping options are described at clause 5 below. We charge by weight and at checkout a full summary of costs you will be required to pay will be shown.

3.3 Our prices are reviewed periodically.

4. CANCELLATION AND RETURNS POLICY

4.1 If you wish to cancel your order:

  1. you may notify us in writing by post or by email by using the CONTACT US button at the top of the website, before we have dispatched the goods to you; or
  2. where goods have already been dispatched to you, by returning goods to us in accordance with clause 4.2 below. We do not accept returns outside the website terms and if you ignore them and simply return goods to us, you will be required to pay the shipping cost to have them sent back to you. This facility will be held open for a reasonable time, after which time the goods will be donated to charity.

4.2 You must notify in writing of your wish to return goods you have ordered from us and this can be for any reason at any time within 7 days of delivery/receipt by you, or attempted delivery if you were not home to accept goods, for a full refund or exchange; this is in accordance with the provisions of the Distance Selling Regulations and does does not affect your statutory rights. When you return the goods to us the costs of returning goods to us shall be borne by you. For your own protection, when returning goods, we suggest that you use, as we do, a recorded or signed-for delivery service to cover the value of the item and obtain proof of postage; this is considered to be reasonable endeavour on your part. We will not be held responsible for returned parcels that are lost in the post and that do not reach us. You will be able to file a claim for compensation using your proof of delivery and invoice, in the event the item is lost. IT IS VITAL that you contact us in writing, by email or post, BEFORE RETURNING GOODS and within the 7 days, to obtain a returns number, as at this point your request to return is logged in respect of the provisions of the Distance Selling Regulations. We politely ask you to then return the item(s) by return of post, as our items are often seasonal and any delay on your part may prevent re-sale. Overseas customers MUST mark the package ‘RETURN’, nil value, otherwise duty/customs charges might be levied and you agree you will then be liable for those costs. Where duty/customs charges are levied that we must pay, you agree that we may deduct payment as an additional charge to the original order.

4.3 With respect to returns under clause 4.2, we will give you a refund, or, alternatively an exchange credit, or make an exchange, if requested by you. We endeavour to process returns quickly however please allow a maximum of 30 days for refunds to be processed by whatever method you used to pay.

4.4 The rights to return the goods to us as referred to in clause 4.2 WILL NOT APPLY in the following circumstances: -

4.4a In the event that the product has been used or held in an environment likely to impair the goods. The goods must be returned to us in the perfect original saleable condition, which is at our discretion, not worn or washed, not smelling of tobacco or other odours and with the original packaging. Tags MUST remain attached otherwise only a 25% refund of the refund allowable under the terms will be given. You have a duty of care towards goods purchased which includes those being returned. This means that you must ensure that any goods being returned are packaged in such a way that they will not be damaged in transit and to use an appropriate service, to obtain a proof of delivery and to ensure compensation will be available to the full amount, should you have to file a claim if the return goes missing.

4.4b To any products that we have made, ordered or customised specifically for you. Refunds cannot be given for any personalized or customized item or item that we do not stock that you ask us to obtain for us.

4.4c To any item that we have attempted to deliver and you have failed to arrange re-delivery or have failed to collect - and it is returned to us. (Refer to 4.2 where it states,'You can return goods you have ordered from us for any reason at any time within 7 days of delivery/receipt by you, OR ATTEMPTED DELIVERY IF YOU WERE NOT HOME TO ACCEPT GOODS...') If this happens, we can re-deliver to an address of your choice and the shipping cost will be charged to you. We will contact you to make arrangements and we will only hold the item for a reasonable period and then donate to charity.

4.5 The provisions of this Policy clause 4 do not affect your statutory rights, where reasonable time limits will be applied, as appropriate.

4.6 The provisions of this Policy 4 (4.1 to 4.6) are not the normal policies of our retail showroom or retail exhibition sales or similar.

5. DELIVERY POLICY

We usually despatch goods within 1 - 5 working days and as soon as possible if enhanced special delivery service is chosen, however you should allow up to 28 days. If your order is received after 2pm, your order will be received into our order system the following working day, when we will commence the payment checking process and despatch asap thereafter. Please read all clause 5 conditions for full details.

5.1 Deliveries within the UK are made by the service you choose at checkout depending on the weight and size of your order and provided the compensation available covers the order value. Standard courier services to the UK are on a 2 – 4 day delivery basis, usually 2 days and compensation is limited to £50.00. If a higher compensation value is necessary, we will adjust the shipping cost to cover the value of your order and deduct payment accordingly. A signature is required for all services, so please ensure someone over the age of 18, where possible the person who paid for the order, is available to sign for their receipt. A Royal Mail or courier service tracking number will be obtained by us, so that we/you can track the delivery status of your order on the delivery company website. If delivery prices change from those published on our website shown at checkout, we will inform you before you are charged, if more than 20% higher. If delivery is required to an address other than the billing address of the credit or debit card and you have not used a ‘Verified by Visa’ or ‘Mastercard Securecard’ credit card, you must grant permission separately and ensure your landline telephone number is provided. We will contact you by phone or email and orders will not be processed unless we obtain the separate permission.
Important note on Royal Mail Special Delivery. This enhanced compensation service should be chosen if the goods have a higher than standard value, currently £36.00, subject to rules shown on the Royal Mail website. It is a next day service however this commences when payment has cleared our payment processing & check system, undertaken by Protx. We follow this process to offer protection for all concerned throughout the on-line shopping process.

5.2 Deliveries outside the UK are made by the service you choose at checkout. Delivery times are not guaranteed and claims for delays cannot be made. Services offered include Royal Mail International Signed For (ISF) or Royal Mail Airsure (to a more limited number of countries), both subject to a maximum weight of 2kg and standard level of compensation of £36.00. The service chosen must cover the value of the sale and will be upgraded if it does not, as the extra insurance option is required for any item with a higher value. A signature is required for the receipt of the ISF service and the delivery is tracked up to the point it leaves the UK. If you are not home your package will be taken to your post office. If you do not collect it in a timely manner it will be returned to us and we will not refund the order and you will have to pay shipping costs for us to send it again. The Airsure service is tracked right up to the point of delivery. A tracking number can be issued if requested. The Royal Mail services have size and weight restrictions, namely – length, width and depth combined no more than 900mm with the greatest single dimension to be no more than 600mm. The maximum weight is 2000g/2kg. If your item breaches these rules, you can select/or we will change your order to the courier signed for service and the cost will be adjusted accordingly. When we send packages outside the UK by courier, we obtain several quotations to obtain the best price for you. We have issued standard minimum amounts to the website and will adjust these lower or higher (up to 20% more). If the price will be more than 20% higher, we will contact you to obtain your permission. Deliveries outside the European Union may incur local taxes and import duties, which may involve delays, which we are not responsible for and for which 'delay' claims are not possible. The actions of Customs are outside our (and the delivery serices cotrol). You, the customer are solely responsible for the payment of any of these additional charges that may be imposed. We are only able to deliver to the billing address of the credit or debit card for overseas orders, unless you have paid with a ‘Verified by Visa’ or ‘Mastercard Securecode’ enabled credit card.

The terms applying to the courier service, with a standard compensation level of £50 which will be increased subject to additional payment, as necessary, relevant to goods sold on this website are: Prohibited (Do not select courier service) – Food Items (to USA/Canada); Jewellery over £250.00
Restricted/No compensation – (If you wish to purchase such goods, they will be sent at your own risk, if this service is selected, as insurance cannot be obtained) – Articles of exceptional value (works of art, antiques, precious stones, gold and silver); furniture (unless flatpacked); Glass/Ceramic/Plaster/Marbel/China/Stone/Resin (or any item containing these materials); laptops/monitors/computers; perishable goods; plants/seeds/flowers; televisions/plasma & TFT screens/Monitors.
If you require a different service to those offered at checkout, please instruct us accordingly by placing a note in the notes box at checkout. Additional charges may apply.

5.3 We do not charge your credit or debit card until we know we are able to despatch the goods (all goods being in stock or en route to us); orders are not processed by us until the day after the initial order, as our acquiring bank carries out several fraud checks to protect you, the customer and us, the vendor. We recommend you sign up your visa or master card credit card to ‘VERIFIED BY VISA’ and ‘MASTERCARD SECURECODE’. You will have to enter a pin number at the time of checkout. If you are redirected to set this up, don’t close the browser and do come back to the website to complete your order. These systems protect all concerned and will soon be available throughout the world. We aim to dispatch most orders within 1-5 days of receipt, however 28 days should be allowed. Once dispatched most UK orders should arrive the next day and non-UK deliveries should take 1-5 days. Every effort is made to deliver your goods within the estimated time scales. From time to time delays may occur. We will not be held liable for failed deliveries or delays beyond our control. We cannot control Customs interventions and for this reason 'delay' claims cannot be made. If you require urgent delivery, please place a note in the notes box at checkout, to INCLUDE the date you would like to recive your order by, or contact us by telephone and we will try to help. In the UK this would involve the selection of the guaranteed special delivery service.

5.4 Your acceptance of delivery requires a signature by an adult over the age of 18 and this should, wherever possible, be the cardholder that made the original order.

5.5 Delivery Costs

  1. Within the UK – Our standard postage charges, for the Royal Mail ‘Recorded Signed For’ service is provided at checkout based on the weight of your package. Alternative options will be given and you should choose the most appropriate option based on the value of the goods, noting that the standard level of compensation is limited to £36.00. If you wish to guarantee your delivery and such postal service is available, you should select a postage service that provides adequate cover/guarantee option. UK Vat applies to postage costs to UK and Europe, as we are a VAT registered company.
    Please contact us if you would like us to use a courier next day service, which we must book in a timely fasion. Additional charges will apply.
  2. To Europe, USA and Rest of World – The standard services are Royal Mail International Signed For or Airsure or international courier, see clause 5 for details. Details are provided at checkout based on the weight of your package.
    Please contact us if your order is urgent, as it may be possible to arrange an express delivery. Additional charges will apply.
